Experience
Acting for heavy machinery manufacturer in commercial disputes involving the sale of equipment and advising and assisting in regard to contract negotiations for the supply of mining equipment.

Acting for one of the parties/shareholders in the purchase of Alliance Airlines.

Assisting a train operator in negotiations with Australian Rail Track Corporation (ARTC) and others with respect to various rail track access agreements. Also assisting the train operator in relation to negotiation and drafting of rail services agreements (agreements for provision of maintenance, locomotives and train crews and the like) and other rail-related agreements.

Acting for a train operator in regard to major train derailment incidents including:

• Successful defence of multi-million dollar claims by ARTC for track damage sustained in derailments.
• Successful prosecution of claims (including a $4m claim) by a train operator against ARTC for damage to the train operator’s rolling stock caused by ARTC’s failure to maintain the rail track.

Conducting the defence on behalf of an engine manufacturer in claims arising from the installation of its engines as the main propulsion unit in certain fishing vessels.

Conducting the defence on behalf of an aircraft operator/its insurer in a claim for approximately $1.3m arising from the loss through destruction of an aircraft. The claim involved 11 parties and was resolved on favourable terms on the eve of trial.

Acting for clients in claims against insurers and insurance brokers.

Acting for clients in multi-million dollar claims in complex multi-claim multi-party proceedings.
